TERMS OF SERVICE

The Church of the Sacred Synthesis
A 508(c)(1)(a) Religious Organization

1. Organizational Identity

These Terms of Service (“Terms”) govern access to and use of all websites, platforms, communications, memberships, events, sacraments, and services (collectively, the “Service”) operated by The Church of the Sacred Synthesis, a faith-based religious organization recognized under 26 U.S.C. § 508(c)(1)(a) (“Church,” “we,” “us,” or “our”).

By accessing or using the Service, you affirmatively agree to be legally bound by these Terms. If you do not agree, you must immediately discontinue use of the Service.


2. Definitions

  • “Service” means the Church’s website(s), membership platform, ceremonies, sacraments, conclaves, digital content, SMS communications, educational materials, and in-person events.

  • “Sacraments” means entheogenic or spiritual materials used solely as part of religious exercise, ceremony, or devotion.

  • “Member” means any individual who registers for, participates in, or engages with Church offerings.

  • “You” means the individual accessing or using the Service.


3. Eligibility and Affirmative Attestation

By accessing the Service, you affirmatively represent and warrant that:

  1. You are at least eighteen (18) years of age.

  2. You are voluntarily participating for religious and spiritual purposes only.

  3. You understand the Church does not provide medical, psychiatric, psychological, or therapeutic services.

  4. You are not relying on the Church for diagnosis, treatment, or cure of any condition.

  5. You affirmatively accept these Terms via clickwrap or equivalent affirmative assent.


4. Religious Use, RFRA Assertion, and Legal Risk Disclosure

All sacraments, ceremonies, and teachings are offered exclusively as part of religious exercise, which the Church asserts is protected under the Religious Freedom Restoration Act (42 U.S.C. § 2000bb-1) and the First Amendment.

However, you expressly acknowledge and agree that:

  • Certain sacraments may be classified as Schedule I substances under the U.S. Controlled Substances Act or analogous state laws.

  • RFRA protections are not guaranteed in all jurisdictions.

  • The Church does not represent or warrant that participation is lawful in your jurisdiction.

  • You alone are responsible for determining the legality of your participation based on your location.

Participation is entirely voluntary and undertaken at your own legal risk.


5. Membership and Community Participation

Membership may include access to ceremonies, sacraments, integration calls, educational materials, events, and communications.

By becoming a Member, you agree to:

  • Comply with all Church guidelines, safety protocols, and community standards.

  • Use sacraments only within authorized religious contexts.

  • Maintain confidentiality of private Church activities.

  • Refrain from diversion, resale, or misuse of sacraments.

The Church reserves the right to suspend or revoke membership at its sole discretion, with or without notice.


6. Health Self-Certification and Screening Attestation

By participating, you affirmatively certify that:

  • You do not have any physical, mental, or psychological condition that would make participation unsafe.

  • You are not under the influence of contraindicated medications or substances.

  • You have independently consulted licensed professionals if needed.

You understand that the Church may require additional screening or disclosures as a condition of participation.


7. Assumption of Risk, Waiver, and Release

You expressly acknowledge that participation may involve intense physical, emotional, psychological, or spiritual experiences.

To the fullest extent permitted by law, you:

  • Assume all risks, known and unknown.

  • Waive and release all claims against the Church, its leaders, officers, facilitators, volunteers, and affiliates.

  • Agree not to sue for any injury, distress, loss, or damage arising from participation, except where prohibited by law.


8. Indemnification

You agree to indemnify, defend, and hold harmless the Church and its representatives from any claims, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising out of:

  • Your participation

  • Your misuse of sacraments

  • Your violation of these Terms

  • Any unlawful conduct attributable to you


9. SMS / Mobile Messaging (TCPA-Compliant)

By opting in, you provide prior express written consent to receive automated or non-automated SMS messages.

Consent is not required as a condition of membership or participation.

You may opt out at any time by texting STOP. Standard message and data rates may apply.


10. Intellectual Property

All Church content, teachings, protocols, recordings, writings, artwork, and materials are proprietary and protected. Unauthorized use, reproduction, or distribution is strictly prohibited.


11. Prohibited Conduct

You agree not to:

  • Use sacraments for non-religious purposes

  • Distribute or resell sacramental materials

  • Misrepresent your identity or intent

  • Engage in conduct that endangers others or the Church


12. Termination

The Church may terminate access or membership immediately for violations of these Terms or conduct inconsistent with Church values or safety standards.


13. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind.


14. Limitation of Liability

To the maximum extent permitted by law, the Church’s total liability shall not exceed the greater of:

  • $100, or

  • The amount paid by you to the Church in the prior 12 months.


15. Mutual Binding Arbitration (Colorado)

Both you and the Church agree that any dispute shall be resolved exclusively by binding arbitration in the State of Colorado, under AAA rules.

You waive any right to a jury trial or class action.


16. Governing Law

These Terms are governed by the laws of Colorado, subject to applicable federal RFRA protections.


17. Severability and Modifications

If any provision is held unenforceable, the remainder shall remain in effect. The Church may update these Terms with notice.
